　————市规划局关于新形势下城乡规划领域党风廉政建设的几点思考

　随着当前城市建设的高速推进，负责城乡规划编制、实施和监督的规划管理部门成为各种违纪问题的“多发地带”，反腐败斗争的形势十分严峻。近年来，青岛、福州、南充规划局局长、成都规划局两名副局长、昆明连续三任局长、海口市规划局四名班子成员都因腐败受到严惩。去年和今后，我局原局长余亚军、科长李水清也因受贿受到处理。尽管只是个案，但对规划队伍的整体形象造成了极大的损害。这些问题的发生，除了体制上原因外，也暴露出当前规划领域党风廉政建设工作还存在着不同程度的薄弱环节。在这里，我就规划领域如何在新形势下加强党风廉政建设，从源头上预防和治理腐败浅谈一点拙见。一、规划领域党风廉政建设存在的主要问题当前规划领域党风廉政建设主要有以下几个方面的问题：一是思想认识不够到位。个别干部认为抓党风廉政建设是纪检监察部门的事，在具体工作中存在“一手硬一手软”等现象。也有少数党员干部认为，自己既无人权又无财权，抓党风廉政建设与自己无关。还有的则存在“规划是业务部门，业务搞好了，党风廉政建设自然会好”的片面认识。二是宣传教育还待加强。绝大多数人已感受到党风廉政教育的重大意义，但也有少数人还存在一些模糊认识：党风廉政教育年年抓，但社会上腐败现象还是经常发生，因此感到教育无用;党风廉政教育都是些老套套，已经过时了;忽视了党风廉政教育具有长期性、艰巨性的客观事实，有急于求成的思想。三是规划本身技术性较强，检查落实、执行监督存在困难。规划审批过程因涉及技术较多，隐蔽性较强，纪检监察部门难以介入，特别是容易发生问题的规划调整等环节，纪检监察部门对其监督存在操作性困难。二、强化教育是做好党风廉政工作的基础坚持把党风廉政教育作为建立拒腐防变思想道德防线的基础性工作，纳入思想政治工作的总体部署，从而使广大干部常修从业之德、常怀律己之心、常思贪欲之害、常弃非分之想。通过建立起党委(组)、支部和职能部门“齐抓共管”、各部门协调配合的教育工作机制，进一步提高对党风廉政教育重要性和迫切性的认识，充分发挥教育这个有力武器的作用，增强规划部门干部自律意识，做到慎始、慎微、慎欲、慎权、慎独、慎友，不断提高认识，明辨是非，站稳立场，坚定方向，始终保持清醒的头脑，经受各种挑战和考验。要不断研究新形势下规划领域出现的新情况和新问题，深入实际加强调查研究，不断探索创新党风廉政教育手段，以增强党风廉政教育的针对性和实效性。主要抓好以下几方面的结合：集中式教育与经常性教育结合。做到每季有安排，月月有计划，根据不同时期不同的阶段性工作进行集中专题教育，同时有计划地开展经常性的教育，做到防微杜渐、警钟长鸣。国土资源网收集针对性教育与超前性教育结合。深入了解和准确掌握党员队伍的思想反映和主要问题，根据党员思想或社会上反映出来的一些苗头，有针对性地提出教育内容，超前安排一定主题的集中教育活动，防患于未然。如节日前做到早打招呼，早提要求，做好预防工作;关键部门、关键岗位和关键人物事前有“章法”，事中有“监督”，事后有“检查”，切实杜绝不正之风。正面教育与警示教育结合。坚持正面教育为主，树立典型、弘扬先进，同时针对身边发生的违法违纪和腐败现象，做好对干部的警示教育，运用典型事例进行党纪教育，生动、形象、直观，具有较强的说服力和感染力。把警示教育与正面典型示范教育结合起来，努力使党风廉政教育推得深、沉到底。组织教育与其他方式教育结合。党风党纪教育没有固定模式，除传统的民主生活会、集中上党课、学文件、廉政谈话等形式外，还要不断创新党风廉政教育手段。根据教育的内容，可以适时组织读书演讲、知识竞赛、民主讨论等多种活动，同时应充分利用网络平台开展党风廉政教育。宣传教育不必拘泥于固定形式，见缝插针，不间断地开展学习教育，力求取得最佳效果。同时要将廉政教育向八小时以外、向生活作风教育方面延伸，做到“八小时以内管住，八小时以外管好”，从而筑牢思想防线，全方位增强拒腐防变能力。三、健全审批运行程序是做好党风廉政工作的关键规划领域出现腐败问题与规划审批环节上存在漏洞是分不开的，权力失控的根本症结在于相关制度设计的缺陷，对于规划部门来说，要做好党风廉政建设必须健全审批运行程序，通过清晰平衡的权责体系从源头上防止腐败行为的发生。一是优化审批程序。通过抓好“规划流程再造”，在保证监管到位的前提下，进一步探索最大限度地方便建设单位的运转机制，简化办事程序，提高办事效率，切实解决办事层次和环节过多的弊病，实现审批流程最优化，使办事效率有一个实质性的提高。二是合理分权制约。通过调整科室职责，优化领域分工，实现有效的权力制约，防止权力过于集中。具体到规划审批工作，就是要对审批合理分权制约，部门之间、岗位之间、班子成员之间，既要各司其责，又要相互制约，形成纵横交错的监督制约机制，增强规划审批工作的透明度，严防暗箱操作，防止出现审批权监督的真空。三是定期交流轮岗，保证审批公正。实践证明，干部在一个岗位工作时间久了，社会关系也会随之增多，难免会产生错综复杂的关系网，一些不正常的关系就可能成为腐败现象滋生和蔓延的外部条件。因此，要加大对规划管理人员岗位交流的力度，定期分批轮岗，从人力资源配置上抑制腐败现象的滋生与蔓延。四、推行政务公开和公众参与是推进党风廉政建设的重要手段要遏制权力的泛滥失控，阳光是最好的防腐剂。推行政务公开和公众参与可以保障市民的参与权、知情权和监督权，增加管理透明度，防止权力滥用。在具体执法管理程序中，规划部门应公开执法依据及结果，便于建设单位和市民对许可机关的监督，防止幕后权钱交易。规划要做到批前公示、批中公示、批后公示，将规划全程置于“阳光”下。通过各种媒体，对重要地区和重要项目的规划设计方案进行批前公示，广泛听取公众意见，将公示意见和建议作为规划审批的重要参考。重要项目的规划审批过程中，邀请普通市民、开发商、人大代表、政协委员、新闻记者等公众列席旁听业务会、专家咨询会和规委会，提高决策过程的透明度。建设项目规划方案审批以后，除了施工现场树立《规划公示牌》外，还要在网站和相关媒体上将批准的规划方案图及各项指标、举报电话等向社会公示。公开不涉及密级的规划编制成果，尤其是控制性详细规划成果。要重点做好规划变更调整的公开公示，防止擅自变更规划审批内容，超越面积，越线移位，挤占红绿蓝线等规划腐败行为。在规划设计上，可以考虑将规划区范围内除保密等特殊项目外的建设项目、建筑设计方案，全部纳入规划设计有形市场，实行设计方案国内外公开招标。规划部门在对规划强制性指标进行刚性管理的前提下，给予非强制性指标以充分的市场弹性，以市场化手段激励规划、建筑设计师发挥创造力。五、强化监督是党风廉政建设的保证党风廉政建设所要解决的是党内的思想作风、工作作风和生活作风问题，规划部门要确保廉洁从政就必须确保监督到位，要完善监督体系，重点从加强审批权、执法权、处罚权等方面的事前事中监督入手，关卡前移，提前介入，把党内监督与法律监督、行政监督、舆论监督、群众监督有机结合起来，形成党内监督、行政监督、民主监督和舆论监督相结合的立体监督体系。国土资源网收集首先要充分发挥纪检监察部门的监督作用。纪检监察职能部门要全方位了解掌握规划各项工作，使规划管理各项工作和每位干部都置于有效的监督之下，不留死角。同时做好强化党纪、政纪、法律和经济等各种监督的协调配合，形成有利于发挥反腐败整体功能的监督机制。纪检监察职能部门要在工作中不断创新监督手段，如我局结合效能监督，坚持每月对各科室建设项目办理时限情况张榜公布，每周对各科室及个人办理项目进行跟踪问效。今后还要进一步完善和规范重大项目招投标、大额度资金使用等重大事项的运作程序，以制度来保障工作的规范。纪检监察部门在规划审批和招投标及评审过程中，要全程参与，防止暗箱操作。其次要拓宽渠道，加强群众监督和社会监督。在政务公开、规划公示的基础上要进一步拓宽监督渠道，将监督工作延伸到八小时以外，真正实现全天候监督。领导干部要自觉接受群众监督，善纳群言，主动让下级来“管”自己，在干部人事工作中要完善、坚持民主推荐和民主评议制度，推行领导干部任前公示、竞争上岗等制度。另一方面，要让广大群众增强行使监督权力的观念，主动通过正常途径和渠道，向上级领导干部和规划部门提出批评和建议。通过上下联动、左右互通的社会立体监督网络，形成人人接受监督，人人参与监督的良好机制。再次是要充分发挥新闻舆论监督作用。新闻舆论监督是防止公务员滥用权力、搞不正之风的有力工具，通过媒体对各种滥用权力、以权谋私的腐败行为及时揭发、举报，将提高规划部门尤其是职权较大的党员干部防止腐败的意识，使其不敢轻易冒风险。
